What are compliance aspects?

Publicity Marketplace is committed to maintaining a transparent, secure, and legally compliant ecosystem for brands, publishers, and agencies. To ensure trust and integrity across all media transactions, all users must strictly adhere to the following regulatory frameworks, data privacy laws, and advertising standards.

1. Data Privacy & Global Protection Laws
When executing digital marketing campaigns, collecting leads, or tracking audience metrics, users must comply with all applicable data protection laws based on target audience location:
  • GDPR & UK GDPR: Campaigns targeting European Union or United Kingdom residents must have a clear legal basis for data processing and secure explicit user consent for tracking.
  • CCPA / CPRA: Campaigns targeting United States residents must provide clear disclosures regarding data sharing practices, honor "Do Not Sell/Share My Personal Information" requests, and offer easy opt-out mechanisms.
  • Data Minimization: Publishers and advertisers may only collect, process, and retain the minimum amount of consumer data required to fulfill the specific ad placement.
2. Advertising Standards & Truthfulness
To protect consumers and maintain marketplace integrity, all promotional materials, copy, and creative assets must meet strict truth-in-advertising criteria:
  • Substantiated Claims: Advertisers must possess objective, verifiable evidence to back up all factual claims, metrics, or performance results stated in their advertisements.
  • Prohibited Content: The platform strictly prohibits the publication of deceptive, fraudulent, or intentionally misleading statements.
  • Regulatory Compliance: All listings and campaigns must align with the guidelines of governing bodies, such as the Federal Trade Commission (FTC) in the US and equivalent advertising standards authorities globally.
3. Clear Sponsored Disclosures
Transparency is a core pillar of our marketplace. Audiences must always be able to easily distinguish between paid promotional placements and organic editorial content:
  • Native Advertising: Any sponsored article, advertorial, or digital post arranged through the marketplace must feature prominent, unambiguous labels such as "Sponsored Content," "Ad," or "Paid Partnership."
  • Influencer & Social Media Placements: Social media endorsements or influencer-driven publicity must include clear, immediate disclosures (e.g., #ad or #sponsored) above the fold.
  • Search Engine Guidelines: Publishers must utilize appropriate HTML tags (such as rel="sponsored") for paid links to comply with search engine webmaster guidelines and protect site indexing.
4. Restricted & Special Ad Categories
Certain industries are subject to heightened scrutiny and rigid compliance frameworks due to legal sensitivities:
  • Housing, Employment, & Credit (HEC): Campaigns within these sectors must be configured to prevent discriminatory targeting based on age, gender, race, or other protected classes.
  • Financial Services & Crypto: Promotions for financial products, investment opportunities, or digital assets must include necessary risk disclosures and comply with regional financial conduct regulations.
  • Healthcare & Pharmaceuticals: Health-related ads, wellness claims, and patient data collection must strictly comply with regional healthcare laws, such as HIPAA in the United States.
5. Intellectual Property Rights (IPR)
  • Copyright & Licensing: Users must own or hold the explicit commercial licenses for all imagery, graphics, video, fonts, and audio tracks utilized in their campaign creatives.
  • Trademark Protection: Advertisers may not use trademarked names, logos, or brand assets in a manner that implies unauthorized endorsement, affiliation, or partnership.

Failure to comply with these marketplace standards may result in immediate campaign suspension, asset rejection, or account termination. For specific compliance inquiries regarding your media listings, please contact our Support Team.
